1. Acceptance of Terms

By accessing or using the website at starguardlaw.com (the “Site”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must not use this Site.

These Terms constitute a legally binding agreement between you and StarGuard Law P.C. (“StarGuard Law,” “the Firm,” “we,” “our,” or “us”). We reserve the right to revise these Terms at any time in our sole discretion by posting updated Terms on this page. Your continued use of the Site following any change constitutes your acceptance of the revised Terms. It is your responsibility to check this page periodically for changes.

These Terms apply to all visitors, users, and others who access or use the Site, regardless of jurisdiction.

2. No Attorney-Client Relationship

Accessing or using this Site does not create an attorney-client relationship between you and StarGuard Law, any attorney affiliated with StarGuard Law, or any employee of the Firm.

An attorney-client relationship with StarGuard Law is formed only when: (a) you have submitted a written request for legal representation; (b) the Firm has completed a conflict-of-interest check; (c) the Firm has agreed in writing to represent you; and (d) you and the Firm have executed a written engagement agreement or retainer letter.

The mere act of viewing this Site, submitting a contact inquiry, scheduling a consultation, or communicating electronically with anyone at StarGuard Law does not constitute a request for legal representation and does not create an attorney-client relationship.

Until a formal attorney-client relationship has been established as described above, StarGuard Law is under no obligation to treat any information you share with us as confidential or privileged. You should not share confidential, sensitive, or privileged information through this Site or any unsolicited communication until a written engagement agreement is in place.

3. No Legal Advice — Informational Only

The materials, articles, guides, resources, and other content published on this Site (collectively, “Content”) are provided for general informational purposes only. Nothing on this Site constitutes legal advice, legal opinion, or a substitute for legal counsel. The Content does not necessarily reflect the most current legal developments and may not apply to your specific facts, circumstances, or jurisdiction.

Do not act or refrain from acting based on anything you read on this Site without first obtaining advice from a qualified attorney licensed in your jurisdiction.

By submitting any communication through this Site before an engagement agreement is executed, you acknowledge and agree that:

  1. Your communication is not confidential and is not protected by attorney-client privilege;
  2. StarGuard Law may be free to represent parties whose interests differ from yours in matters unrelated to any information you submit, unless doing so would materially prejudice your interests in connection with a substantially related matter;
  3. Email and internet transmissions are not inherently secure; and
  4. You should not submit any trade secrets, confidential business information, sensitive personal information, or information about pending litigation through this Site until a signed engagement agreement is in place.

If you choose to submit information prior to executing an engagement agreement, you do so with full understanding that it may not be treated as privileged or confidential.

5. Intellectual Property

5.1 Ownership

All content on this Site — including without limitation text, articles, guides, graphics, logos, images, design elements, page layouts, trademarks, service marks, trade dress, and software — is owned by StarGuard Law P.C. or used with permission, and is protected by United States copyright law, Canadian copyright law, and applicable international intellectual property laws and treaties.

“StarGuard Law,” the StarGuard Law logo, and all related names, logos, taglines, and trade dress are trademarks and service marks of StarGuard Law P.C. You may not use any StarGuard Law mark without prior written permission from the Firm.

5.2 Limited License

Subject to your compliance with these Terms, StarGuard Law grants you a limited, revocable, non-exclusive, non-transferable, personal license to access and use the Site and its Content solely for lawful, non-commercial, personal informational purposes. You may print or download a single copy of pages from the Site for your personal, non-commercial use, provided that you maintain all copyright and other proprietary notices.

5.3 Prohibited Uses

You may not, without prior written permission from StarGuard Law:

  1. Reproduce, publish, republish, distribute, or transmit any Content for commercial purposes;
  2. Modify, adapt, translate, or create derivative works based on any Content;
  3. Remove, alter, or obscure any copyright notice, trademark, or other proprietary notice from any Content;
  4. Use any Content in a manner that suggests any association with, sponsorship by, or endorsement from StarGuard Law when none exists; or
  5. Use automated systems, bots, scrapers, crawlers, or data mining tools to extract Content from the Site.

All rights in and to this Site and its Content not expressly granted in these Terms are reserved to StarGuard Law.

5.4 Copyright Infringement Claims

If you believe that Content on this Site infringes your copyright, please send a written notice to info@starguardlaw.com with the subject line “Copyright Infringement Notice” that includes: (a) identification of the copyrighted work claimed to have been infringed; (b) identification of the allegedly infringing material and its location on the Site; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

6. Acceptable Use

You agree to use this Site only for lawful purposes and in compliance with all applicable local, state, national, and international laws. You agree that you will not:

  1. Use the Site in any manner that violates any applicable law, including without limitation laws governing attorney-client relationships, professional conduct, data privacy, spam, or consumer protection;
  2. Transmit any unsolicited or unauthorized advertising or promotional material, junk mail, or spam;
  3. Impersonate or attempt to impersonate StarGuard Law, any attorney, employee, or agent of the Firm, or any other person or entity;
  4. Introduce any virus, trojan horse, worm, ransomware, or other malicious or technologically harmful material;
  5. Attempt to gain unauthorized access to any portion of the Site, any server on which the Site is stored, or any database connected to the Site;
  6. Engage in any conduct that restricts or inhibits any other person's use or enjoyment of the Site, or which may harm the Firm or users of the Site; or
  7. Harvest, compile, or extract any data or information from the Site using automated means or processes.

We reserve the right to terminate or restrict your access to this Site immediately, without notice, if we determine in our sole discretion that you have violated any provision of these Terms.

7. Limitation of Liability

7.1 “As Is” Disclaimer

The Site and all Content and materials on the Site are provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, StarGuard Law disclaims all warranties, express or implied, including without limitation implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

StarGuard Law does not warrant that: (a) the Site will be available at all times or without interruption; (b) the Content is accurate, complete, current, or error-free; (c) the Site or any Content is free from viruses or other harmful components; or (d) any defects or errors in the Site will be corrected.

7.2 Exclusion of Liability

To the fullest extent permitted by applicable law, StarGuard Law, its attorneys, employees, agents, officers, and affiliates shall not be liable to you or any third party for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages of any kind arising out of or in connection with: (a) your access to or use of, or inability to access or use, the Site or any Content; (b) any reliance placed by you on the Content, including any reliance on information that may appear to be legal advice but which is general information only; (c) any unauthorized access to or alteration of your transmissions or data; (d) any conduct or content of any third party on or accessed through the Site; or (e) any errors, omissions, or inaccuracies in the Content, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not StarGuard Law has been informed of the possibility of such damage.

7.3 Jurisdictional Savings Clause

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. The limitations in this Section apply only to the extent permitted by applicable law. Nothing in these Terms limits or excludes any liability that cannot be excluded or limited by applicable law in Ontario or Quebec, including liability for gross negligence or willful misconduct where such exclusion is prohibited by applicable Canadian law.

7.4 No Duty to Update

StarGuard Law is not obligated to update the Content on this Site to reflect changes in law and shall not be liable for any reliance on outdated information.

This Site may contain hyperlinks to third-party websites, resources, social media platforms, scheduling tools, and other services not operated or controlled by StarGuard Law. These links are provided for convenience only. The existence of a link does not constitute an endorsement, sponsorship, or recommendation of the linked site, its content, or its operator.

StarGuard Law has no control over the content, privacy practices, or availability of third-party sites and accepts no responsibility for any loss or damage that may arise from your use of them. Accessing any third-party site is done entirely at your own risk and subject to that site’s own terms and privacy policy.

In particular, links to scheduling and client intake platforms lead to services operated by third parties. Use of those platforms is governed by their own terms of service.

10. Governing Law

10.1 General

These Terms and your use of this Site shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

10.2 California Visitors

Any dispute arising out of or relating to these Terms or your use of this Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

10.3 Canadian Visitors

For users located in Ontario or Quebec, StarGuard Law acknowledges that applicable mandatory consumer protection laws and professional responsibility codes in those provinces may impose requirements that supersede or supplement the terms of this Section. Nothing in this Section is intended to deprive a Canadian resident of protections that cannot be waived by contract under applicable Canadian law. Ontario residents may bring proceedings in Ontario courts; Quebec residents may bring proceedings in Quebec courts where required by Quebec law.

10.4 Limitation Period

Any claim arising out of or relating to your use of this Site must be brought within one (1) year after the claim arises, to the extent permitted by applicable law.

11. Changes to These Terms

StarGuard Law reserves the right to modify these Terms at any time without prior notice, except where notice is required by applicable law. Changes are effective immediately upon posting to this page. The “Last Reviewed” date at the top of this page will reflect the date of the most recent revision.

Your continued use of this Site after any revision constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.
